Leni pinangaralan ng netizen matapos mabahala sa sinapit ni Sereno

Leni, may bagong pakabahala na naman!

Matapos lumabas ang hatol ng korte suprema kay dating Chief Justice Maria Lourdes Sereno, agad namang nagpahayag ng kanyang saloobin si Vice President Leni Robredo.

Base kasi sa desisyon na ibinaba ng naturang korte, lumabas na nangibabaw ang mga hukom na pumabor sa pagpapatalsik sa dating Chief Justice.

Ito ay sa kabila ng nakasaad sa konstitusyon na tanging impeachment lamang ang makakapagpatalsik sa Chief Justice, nanaig pa rin ang desisyon ng korte suprema.

Sa botong 8-6, walo ang pumabor sa pagtanggal kay Sereno. Ito ay sa pamamagitan ng inihain ni Solicitor General Calida na quo warranto petition kay Sereno, o ang nagpapawalang-bisa ng appointment ni Noynoy Aquino sa pinalayas na hukom.

Dahil dito, sinabi ni Robredo na ang ginawa kay Sereno ay "tahasang pagyurak sa pinaka-sagradong institusyon ng bayan: ang ating Saligang Batas".

Dagdag pa nya, "tanging impeachment lamang ang paraan upang tanggalin sa puwesto ang isang impeachable officer, tulad ng Punong Mahistrado."

Ang mga pahayag na ito ni Robredo ang nag-udyok sa isang netizen upang ipaliwanag sa bise presidente ang naging hatol kay Sereno.

Sa pamamagitan ng open letter sa Facebook, ipinaliwanag ni Maricor Meneses kay Leni ang naging takbo ng kaso ni Sereno.

Madam VP Leni Robredo,

Sabi nyo po, "Tahasang pagyurak sa pinaka-sagradong institusyon ng bayan: ang ating Saligang Batas."

Allow me to articulate in English. With all due respect, please read and re-read then comprehend, then analyze Article VIII of the Philippine Constitution: "The JUDICIAL POWER shall be VESTED in ONE Supreme Court and in such lower courts as may be established by law." I supplied the emphasis, you know, for full effect.

The SC only articulated the laws, fundamentally, the Constitution and all its applicable laws, particularly the Rules of Court. It is merely exercising its jurisdiction over the petition.

You further stressed, "...tanging impeachment lamang ang paraan upang tanggalin sa puwesto ang isang impeachable officer, tulad ng Punong Mahistrado."

First off, can you please cite the provision in Article VIII where it is stipulated 'except against the Chief Justice'?

Second, how can you impeach an official who is NOT impeachable? When the official you are referring to is DISQUALIFIED to hold the office of the Chief Justice in the first place.

So, what's this nonsense "Ngayong nakompormiso ang pinaka-pundasyon ng ating hudikatura"? As a lawyer you ought to know better.

Madam, I suggest that you dust off your law books and brush up on every gaddamn law applicable to every Filipino.

Is the Chief Justice the judiciary? This country's highest court is made up of a collegial body di po ba? It exercises its judicial power through the collective action of its individual members. And the Chief Justice is just ONE among the 15 justices.

One thing is crystal clear here, your fear of the quo warranto is astounding. You are practically spreading dumbfounded claims. Yes, quo warranto is a landmark decision and it sets a precedent, by setting the bar two notches higher.

Now, let me ask you this Madam, paki-update naman po ang taumbayan tungkol sa SOCE mo?

Sa isa pang Facebook post, ipinaliwanag din ng parehong netizen na si Meneses ang dahilan kung bakit malinaw ang pagkakaintindi nya sa ginawang desisyon ng korte kahit hindi sya eksperto sa usaping ito.

Ouster of Maria Lourdes Sereno is an obvious attack to the judiciary? Naglukuksa ang bayan dahil nawala ang kredibilidad ng Korte Suprema?

Wait, what?!

I am no legal expert, heck, I never took up law. However, I have a gift of logic and critical thinking is a skill I take pride of.

So how do I make sense out of this argument? I can only assert that the exaggeration is bursting at the seams. Ridiculous to a fault.

So allow me, a non-lawyer, to ask, is the Chief Justice the judiciary?

Last I checked, this country's highest court is made up of a collegial body. It exercises its judicial power through the COLLECTIVE action of its individual members.

And the Chief Justice is just ONE among the fifteen (15) justices.
