Glenn Chong Slams Leni's lawyer: "NAKIKISAWSAW DIN SI MAC WALANG KWENTA NAMAN ANG SINABI!"

Amid the on-going squabble that is happening in the country right now because of the recent revocation of amnesty of the most controversial senator himself, Antonio Trillanes IV, opinions from political analysts, legislators, media and netizens are everywhere.

Political opponents expressed different beliefs and perceptions over President Rodrigo Duterte's decision to invalidate the grant of amnesty to Senator Trillanes and orders his arrest.



Those pro-administration were very in favor of it and were ecstatic with the idea of the senator being locked up in prison, but of course, the oppositions or the dilawan were aghast and upset about it.

Disputes have raged over the news and social media and many declared their inevitable interpretation, scrutinies and theories, one of which is Leni Robredo's lawyer, Atty. Romulo Macalintal, who stated that the military tribunal cannot re-acquire jurisdiction over Senator Trillanes, since the latter has been considered resigned from the military after he filed his certificate of candidacy (CoC) when he initially run for senator.

This remarks of Atty. Macalintal dismayed yet another election lawyer and now a well-known election fraud battler, Atty. Glenn Chong.

In his latest Facebook post, Atty. Chong slams Macalintal and said that the latter's opinion is actually unnecessary, pointless and worthless.

"Ayon sa abogado ni Leni Robredo na si Atty. Macalintal, hindi na maaring mabawing muli ng militar ang kapangyarihan nito kay Trillanes kahit pa pinawalangbisa ang amnesty niya dahil tumiwalag na si Trillanes sa militar nang siya ay magfile ng certificate of candidacy noong tumakbo siyang senador."

"This is pointless and immaterial. Walang kwenta.", Atty. Chong wrote.

He then explained the legal process that will be taken after if at any time Trillanes will be arrested, hence, gave emphasis to the fact that only the police and not the military can arrest the senator with the warrant of arrest from the court.

Likewise, Atty. Chong denoted that only the court has the power to decide on the senator's issue, thus, all the noise of Trillanes' allies, from Robredo, Macalintal, members of the Liberal Party, are useless.

"Ang lahat ng ingay ng mga kaalyado ni Trillanes, mula kay Robredo, Macalintal, mga kasapi ng Liberal Party, at iba pang mga nilalang na kulay dilaw, samo’t-sari mang ang kanilang anyo – ay wala ring kwenta. Ang hukuman ang may kapangyarihang magdesisyon sa isyung ito.", he uttered.

Sinabi na ng DOJ na hindi aarestuhin si Trillanes kung walang warrant of arrest. Kaya nga naghain sila ng application for alias warrant of arrest sa Regional Trial Court upang ang korte na ang mag-utos sa kapulisan. Samakatuwid, ang kapulisan lamang ang maaring umaresto kay Trillanes sa bisa ng warrant of arrest mula sa korte, at hindi ang militar ang aaresto sa kanya. At dahil korte ang magpapalabas ng warrant of arrest, kung sakali, ibig sabihin ang korte ang may kapangyarihan o jurisdiction sa kaso at hindi ang court martial ng militar.

Kapag kinatigan ng korte ang application ng DOJ, saka lamang maaring arestuhin si Trillanes. Hindi maaring pumalag ang Senado kung aarestuhin na si Trillanes dahil ang parliamentary immunities ng mga kasapi ng Kongreso ay may bisa lamang kung ang kaukulang parusa ng krimeng ginawa ng kasapi nito ay hindi lalagpas sa 6 na taong pagkakakulong ayon sa Sec. 11 ng Article VI ng saligang-batas.

Ang krimen ni Trillanes ay rebellion at coup d’etat na parehong may kaukulang parusa na reclusion perpetua. Ito ay may hangganan na 20 years + 1 day hanggang 40 years na pagkakakulong sa ilalim ng Art. 135 in relation to Art. 27 ng Revised Penal Code. May kasama rin itong accessory penalties. Maari lamang siyang makakuha ng pardon pagkalipas ng 30 taon na pagkakakulong.

Kapag kinatigan ng korte ang application ng DOJ, ang nalalabing pag-asa ni Trillanes ay kung kakatigan siya ng Korte Suprema at mag-isyu ito ng temporary restraining order o TRO. Kung walang TRO, balik selda muna si Trillanes.

Ang lahat ng ingay ng mga kaalyado ni Trillanes, mula kay Robredo, Macalintal, mga kasapi ng Liberal Party, at iba pang mga nilalang na kulay dilaw, samo’t-sari mang ang kanilang anyo – ay wala ring kwenta. Ang hukuman ang may kapangyarihang magdesisyon sa isyung ito."
